Terms of Sale
Plain-English terms for orders placed with Apex Fabrication — the way we'd explain them across the shop counter. Effective August 31, 2026.
Two kinds of products, two sets of rules
Stock parts — off-the-shelf conveyor components sold at listed prices — can be returned. Custom and cut-to-order goods — per-foot chain and profile cuts, built-to-order conveyors, and custom fabrication — are made for your order and can't be restocked. Every product page tells you which kind you're buying.
Returns on stock parts
Unused stock parts in their original condition may be returned within 30 days of delivery. A 15% restocking fee applies, and the buyer pays return shipping. Call or email us first — (219) 509-3083 / office@apexfabricationllc.com — and we'll get you squared away fast.
Wrong part? We make it right. If we shipped something other than what you ordered, we pay the freight both ways and fix it — no fee, no argument.
Custom & cut-to-length work
All sales of custom-fabricated and cut-to-length items are final once production begins. Custom fabrication requires a 50% deposit before work starts. The deposit covers material and setup; if you cancel before work begins, we refund it less any costs already incurred (material ordered, engineering time spent).
Fitment is your call — but we'll help you make it
You are responsible for confirming a part fits your equipment and application. We publish specs and measurements so you can verify before ordering — and we're glad to help you check by phone or email — but the final fitment decision is yours.
Warranty
Resold components (manufacturer-brand parts we stock) are sold AS IS. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Where the manufacturer offers its own warranty, that warranty passes through to you.
Apex-fabricated work carries a 90-day workmanship warranty: if our welding or fabrication fails in normal use within 90 days, we repair or replace it — that repair or replacement is the sole remedy.
Limitation of liability
Our total liability on any order is capped at the amount you paid for that order. We are not liable for consequential or incidental damages — including downtime, lost production, or damage to equipment — arising from use of a part. Some states don't allow these limits, so they may not apply to you.
Lead times & order acceptance
Stated lead times per product apply from properly completed order. Your order is an offer, which we accept when we confirm or ship it — this protects both of us against pricing errors. Prices are in USD, plus applicable sales tax.
Governing law
These terms are governed by Indiana law; venue is Porter County, Indiana.
